    BASIC INFORMATION
    Registration of an action concerning legal status (birth, marriage, divorce, death) which has taken place outside the borders of the Republic of Poland by signing into Polish registry and issuance of Polish documents confirming its existence is called transcription or registration of foreign vital records. There is no legal duty to register a foreign vital records in the polish
    registry.

    COMPETENT REGISTRY
    Registration of a certificate issued by a foreign Bureau of Vital Records into Polish registry is performed by the competent Bureau .
    It’s competence is based on  the last  place of the residence of the respectable person in Poland. If such person has never had a  permanent residence in Poland, registration is to be performed by the Bureau of Vital Records located in Downtown Warsaw (Warszawa-Śródmieście).

    APPLICATION FOR REGISTRATION
    Application for registration of vital records may be filed in the appropriate/competent Polish registry:

    1. Personally
    2. By an authorized person with Power of Attorney
    3. By the Consulate (subject to fee, the table of consular fees)

    If registration is to be made byanother person, it is necessary for that person to be authorized to file and receive the documents from Polish registry. The authorization shall be certified by the Consul.

    A BIRTH CERTIFICATE REGISTRATION
    To register a foreign birth certificate  in Poland the following documents shall be submitted:

    1. An application form to the Bureau of Vital Records(zał. 1)
    2. An original birth certificate
    3. An official translation of a birth certificate (see above)
    4. In  case where a short version of a birth certificate is presented, the Bureau of Vital Records may require a the marriage certificate of the applicant’s parents or their birth certificates
    5. an authorization form to receive documents from the Bureau(zał.2)


    MARRIAGE CERTIFICATE REGISTRATION
    To register a foreign marriage certificate in Poland the following documents shall be submitted:

    1.  An application form to the Bureau of Vital Records(zał. 3)
    2. An original marriage certificate
    3. An official translation of a marriage certificate
    4. In case of short form of marriage certificate the Bureau of Vital Records may require birth certificates of both spouses.
    5. an authorization form to receive documents from the Bureau(zal. 2)


    If a marriage certificate does not contain information regarding a surname taken after the conclusion of marriage  and:

    1. both spouses hold Polish citizenship- a statement concerning surname taken after the conclusion of marriage should be submitted before  a Consul, who drafts an appropriate protocole.
    2. spouses hold two different citizenships –  Polish national provides a statement concerning surname taken after the conclusion of marriage and Consul drafts a protocol on its basis. Statement must be made personally before a Consul. Whereas the other spouse provides a statement concerning a surname taken after the conclusion of   marriage(zał. 4)  in accordance with to his/her  domestic law.


    If a marriage certificate does not contain information about surname given to the children born out of this marriage
    and:

    In case marriage certificate is to be registered on behalf of  applicants by a person with power of attorney to register the marriage certificate, spouses provide  a written statement concerning the surname taken after the conclusion of marriage and  the children’s surnames. Consul authenticates signatures under the statement.

    DEATH CERTIFICATE REGISTRATION
    To register a foreign death certificate in Poland the following documents shall be submitted:

    1. both spouses hold Polish citizenship – spouses provide a statement concerning children’s surnames, according to Polish law. Statements must be made personally, before Consul. Consul drafts a protocol on its basis.
    2. spouses hold two different citizenships – spouses provide astatement concerning  children’s surnames in accordance with  the law applicable to  the place of residence(zał. 5) /abode

    1. An application form to the Bureau of Vital Records(zał. 6)

    2. An original death certificate

    3. An official translation of a death certificate

    4. an authorization form to receive documents from the Bureau(zał.2)

    In case a short version of the death certificate is presented, the Bureau  of Vital Records may require a  marriage certificate or birth certificate of the deceased person.
