DECISION NO. 14
OF THE MINISTER OF FOREIGN AFFAIRS
Of 26 March 2008
On the scope of activities of the secretary of state and undersecretary of state at the Ministry of Foreign Affairs and the order of replacements of the Minister of Foreign Affairs, the secretary of state and the undersecretaries of state
 

Pursuant to Art. 37 section 2 of the Act of 8 August 1996 on the Council of Ministers
(Journal of Laws of 2003 No. 24, item 199; No. 80, item 717; of 2004 No. 238, item 2390 and No. 237, item 2703; of 2005 No. 169, item 1414 and No. 249, item 2104, and of 2006 No. 45 item 319, No. 170 item 1217 and No. 220 item 1600), the following is hereby resolved:
 
§ 1.
The scope of activities of the secretary and undersecretary of state at the Ministry of Foreign Affairs and the order of replacements of the Minister of Foreign Affairs, undersecretary and secretary of state as given below is hereby determined:

1)   Jan Borkowski, Secretary of State:

1. Participates in the meetings of the Committee of the Council of Ministers
2. Is responsible for the consular policy and the Polish community abroad
3. Is responsible for the relations with the Sejm and the Senate while performing the function of the Parliamentary Secretary
4. Presents the position of the Ministry of Foreign affairs while considering the draft budget act
5. Participates in the works of the Inter-departmental Team for the matters of the Polish Community and Poles abroad
6. Is responsible for the social dialogue issues
7. Participates in the works of the Informatization and Communication Committee of the Council of Ministers
8. Participates in the works of the Inter-departmental Team for the Use of Resources within the Framework of the Schengen Fund and the Norwegian Financial Mechanism
9. Participates in the works of the Government and Territorial Self-government Joint Commission
10. Participates in the works of the Team for the Management of the National Border
11. Replaces the Minister of Foreign Affairs
12. Replaces the Undersecretary of State Bernatowicz with respect to the matters referred to item 2 letters b, c, and d and the Undersecretary of State Andrzej Kremer with respect to the matters entrusted with him;

2)   Grażyna Bernatowicz, Undersecretary of State:

1. Is responsible for European political matters at the bilateral and multilateral level and for the issues related to the policy of the Republic of Poland within the European Union except for the security policy
2. Participates in the meetings of the European Committee of the Council of Ministers
3. Is responsible for the issues associated with the participation of the Ministry of Foreign Affairs in the process of the inter-departmental coordination with respect to the European integration
4. Participates in the development and execution of the National Coherence Strategy
5. Is responsible for the economic dimension of the foreign policy
6. Is responsible for the OECD issues and participates in the works of the Inter-departmental Team for the OECD Matters
7. Is responsible for the issues associated with the Exports Insurance Policy Committee
8. Participates in the works of the International Investments Interdepartmental Team
9. Participates in the works of the Programme Council of the national census of nationals, houses and apartments to be carried out in 2011
10. Participates in the works of the Interdepartmental team for the WTO matters
11. Replaces the Minister of Foreign Affairs in the event of absence of the Secretary of State Jan Borkowski
12. Replaces the Secretary of State Jan Borkowski with respect to the issues vested in him;

3) Ryszard Schnepf, Undersecretary of State:

1. Is responsible for the development and execution of the policy regarding the North and South American, African, Middle East, Asian and Asia Pacific states except for the security policy
2. Is responsible for the international development policy and performs the function of the National Coordinator for the International Development Cooperation
3. Is responsible for the issues which are part of the Diplomatic Protocol
4. Participates in the works of the Steering Committee for the development of the management plan of the former Auschwitz- Birkenau Concentration Camp
5. Is responsible for the coordination and programming of the promotion of Poland in the world
6. Is responsible for the foreign informational, cultural, research and educational policy
7. Participates in the works of the Council of the Polish Institute of International Affairs
8. Participates in the works of the Council for Counteracting Drug Addiction
9. Replaces the Minister of Foreign Affairs in the event of the concurrent absence of the Secretary of State Jan Borkowski and the Undersecretary of State Grażyna Bernatowicz
10. Replaces the undersecretary of the state Grażyna Bernatowicz, in the matters referred to in item 2 letter a and the Undersecretary of State Witold Waszczykowski with respect to the issues entrusted with him;

4)   Andrzej Kremer, Undersecretary of State:

1. Is responsible for the legal and treaty issues
2. Is responsible for the development and execution for the Polish eastern policy
3. Is responsible for the matters which are within the competences of the Strategy and Foreign Policy Planning Department subject to § 2
4. Participates in the works of the Inter-departmental Team for the Modern Economic Regulations
5. Participates in the works of the Concordat Commission
6. Replaces the Minister of Foreign Affairs in the case of the concurrent absence of the secretary of state Jan Borkowski, undersecretary of state Grażyna Bernatowicz and Undersecretary of State Ryszard Schnepf,
   h) replaces secretary of state Jan Borkowski with respect to the matters within his competences during the absence of the Undersecretary of State Grażyna Bernatowicz;

5)  Undersecretary of state Witold Waszczykowski:

1. Is responsible for the issues related to the United Nations and the global issues associated with the organisation of the UN
2. Is responsible for the development and execution of the security policy including the defence, non-proliferation and control of export at the global, multilateral and bilateral level
3. Participates in the works of the Interdepartmental Team for the Defence Industry Restructuring
4. Participates in the works of the Offset Committee
5. Participates in the works of the Government Team for Crisis Management
6. Replaces the Minister of Foreign Affairs in the event of concurrent absence of the Secretary of State Jan Borkowski, Undersecretary of State Grażyna Bernatowicz, Undersecretary of State Ryszard Schnepf and Andrzej Kremer
7. Replaces Undersecretary of State Ryszard Schnepf with respect to the matters within his competences and Undersecretary of State Grażyna Bernatowicz with respect to the issues referred to in item 2 letters e to j and with respect to other matters within her competences in the event of absence of persons replacing her.

§ 2.
Issues associated with the programming of the Polish foreign policy are within the sole competences of the Minister of Foreign Affairs.

§ 3.
Decision No. 2 of the Minister of Foreign Affairs of 7 January 2008 on the scope of activities of the Secretary of State and Undersecretary of State at the Ministry of Foreign Affairs and the order of replacements of the secretary of state and undersecretaries of state is hereby nullified.
 
§ 4.
The decision shall be in force as of the date of its being signed.
